SHANEN IS AN ASSOCIATE DIRECTOR IN INCISIVE LAW. HIS PRACTICE REVOLVES AROUND CONTENTIOUS WET AND DRY SHIPPING WORK.

Shanen handles a wide range of wet and dry shipping litigation and arbitration matters, with a growing specialisation in container liner casualty, marine insurance and bill of lading work.

His primary focus involves advising clients on the full spectrum of charterparty, bills of lading, shipbuilding, commodities, casualties and marine insurance work. He regularly advises shipowners, shipbuilders, P&I Clubs and H&M insurers on a variety of shipping and trade matters.

Shanen’s contentious areas of practice also extends to complex commercial disputes, employment, and general insurance work. On the non-contentious front, Shanen also engages in advisory, insolvency and regulatory work.

Shanen has appeared as counsel across all levels of the Singapore Courts and has an active arbitration practice. He is well versed with both domestic and international arbitrations conducted under the auspices of various arbitral institutions, including SIAC, LMAA, SCMA, ICC and HKIAC.

In his free time, Shanen enjoys hitting the gym and playing a good game of football. He is a proud supporter of Manchester United Football Club.

Matters handled prior to joining the firm:

  • Acted for a prominent international container shipping line and vessel operator in defending claims made against it by dependants of crew following a major fire incident on board the Vessel.
  • Acted / Advised a prominent national carrier in defending claims made against it by partners / cargo claimants following a long 6-month detention by Indonesian Authorities.
  • Acted for a large commodities company in an action against various entities for unlawful means conspiracy following an email hack causing the client’s bank to disburse sums to fraudsters’ accounts. Successfully obtained a mareva injunction freezing the assets of the fraudsters. Claim value exceeded $20m.
  • Acted / Advised a prominent shipping line in respect of its rights under the NYPE form against its charterer following an engine breakdown (involved off-hire issues, NYPE Interclub Agreement Cargo Claims , seaworthiness, speed and performance and other claims).
  • Acted / Advised a prominent container shipping line in defending cargo claims / partner claims arising out of an incident in which containers fell overboard the Vessel in bad weather leading to loss of cargo / containers.
  • Acted / Advised a prominent international container shipping line in defending cargo claims / partner claims arising from a fire caused by mis declared cargo.
  • Advised a reinsurer on a CTL claim worth millions following a major Vessel fire in Sri Lanka.
  • Acted for a buyer claiming damages in excess of US$2million for breach of a Shipbuilding Contract following failure to deliver the Vessel.
  • Acted for a company in an appeal to the Court of Appeal against a decision made vis-à-vis the appropriate sentence to be awarded in respect of a committal application in which the contemnors disobeyed Mareva Injunction restraining disposal of company assets.
  • Acted for Vessel buyers in defending claims made by a prominent shipyard arising out of the construction of 4 assisted drilling rigs under a design and build contract. Claim value in excess of 20 million.
  • Acted for coal suppliers against purchasers for a claim for breach of contract arising out of failure to load cargo
  • Advised a prominent career on its rights following damage to cargo rendering it off-spec (cargo contamination).
  • Acted for a major carrier in an action commenced against it by Cargo Claimants for damage arising out of malfunctioning Reefers.
  • Advised on the full range of charterparty and bill of lading claims.
  • Acted for a university in its claim for $55 million in damages against contractors arising out of an extensive gas leak fire in a laboratory.
  • Acted for a statutory board in defending a claim in excess of $20 million made by a Claimant for damages arising out of a fall into a manhole.
  • Acted for a Warehousing Company in bringing forth a claim against a Logistics Solutions Provider for structural damage to a warehouse claiming damages in excess of $1 million.
  • Acted for various governmental bodies, statutory boards and MCSTs in defending and making claims for fire damage, water damage and other tortious property damage claims.
  • Successfully obtained discharges amounting to acquittals for two clients who were charged under Section 64 of the Road Traffic Act / Section 304A of the Penal Code.
